Automobile Accidents are not the only dangerous form of transportation in Miami. On July 4th a North Miami man was killed when he was struck by a passing boat’s propeller after being intentionally thrown off the boat on which he was traveling. The man was, according to CBS Miami News, drunk and high. The State of Florida charged Eulices Barrios, the man who threw the North Miami resident off of the boat, with Culpable Negligence – punishable by up to 15 years in prison. Ultimately on September 4, 2012 the case was decided by a jury who found Eulices Barrios Not Guilty of Culpable Negligence.
While there will be no criminal punishment, a case for the Wrongful Death of the North Miami resident could certainly be made. That being stated, the deceased North Miami Man’s state of intoxication may become an issue.
